Rosebud Man Pleads Guilty to Assault Charge

U.S. Attorney Brendan V. Johnson announced that Dallas First In Trouble, age 20, of Rosebud, appeared before U.S. District Judge Roberto A. Lange on August 31, 2011, and pled guilty to count two of the indictment that charged him with assault resulting in substantial bodily injury. The maximum penalty upon conviction is five years’ imprisonment.

The charge stems from an incident on September 4, 2009, when a Rosebud Sioux tribal officer responded to a call that the victim had been assaulted by Dallas First In Trouble who was armed with a pistol. While en route, the tribal officer observed a male staggering on the shoulder of the road, approached the male, and identified him as Dallas First In Trouble.

At this point, another individual approached who identified himself as the victim and identified First In Trouble and another male as the individuals who assaulted him.

The investigation was conducted by Rosebud Sioux Tribe Law Enforcement Services and the Federal Bureau of Investigation. The case is being prosecuted by Assistant U.S. Attorney Meghan N. Dilges.

A presentence investigation was ordered, and a sentencing date was set for November 22, 2011. The defendant was remanded to the custody of the U.S. Marshal pending sentencing.
