Fort Yates Man Sentenced for Assaulting Federal Officer

BISMARCK—United States Attorney Timothy Q. Purdon announced that on August 16, 2011, Kevin Little Bear, 54, of Fort Yates, North Dakota, was sentenced in United States District Court on a charge of assaulting and resisting a federal officer. Little Bear pleaded guilty to the charge on May 19, 2011.

Judge Conmy sentenced Little Bear to two years in federal prison, to be followed by two years of supervised release. Little Bear was ordered to pay a $100 special assessment to the Crime Victim’s Fund.

On February 26, 2011, law enforcement officers responded to Little Bear’s residence after receiving a 911 call. While officers arrested Little Bear for suspicion of domestic violence, Little Bear kicked a Bureau of Indian Affairs police officers in the chest and shoulder area. Little Bear was wearing shoes with athletic cleats when he kicked the officer. The officer was not physically injured as a result of the assault. The case was investigated by the Federal Bureau of Investigation and Bureau of Indian Affairs - Standing Rock Agency.

Assistant United States Attorney Gary Delorme prosecuted the case.
