Francisco Martin Indicted for Receipt, Distribution, and Possession of Child Pornography

GREENEVILLE, TN—A federal grand jury in Greeneville returned a two count indictment on September 15, 2010, against Francisco Martin, of Jefferson City, Tennessee, for receipt of child pornography, distribution of child pornography, and possession of child pornography. Martin appeared in court on September 16, 2010, before U.S. Magistrate Judge Dennis H. Inman and entered a plea of not guilty to the charges in the indictment. The United States District Judge, J. Ronnie Greer, has entered an order remanding the defendant to the custody of the Bureau of Prisons for a competency evaluation and staying a prior order of the Magistrate Judge which released the defendant on bond and conditions of release.

The indictment alleges that Martin, on or about July 29, 2010, and for the four years preceding July 29, 2010 , accessed the Internet from his residence and public locations, and distributed and downloaded images of minor children engaged in sexually explicit conduct.

If convicted, Noble faces a term of a minimum of five years and up to 20 years in prison, a fine of up to $250,000, and supervised release of a minimum of five years and up to life.

This indictment is the result of an investigation by the Morristown Police Department, Internet Crimes Against Children Task Force and the Federal Bureau of Investigation. Assistant U.S. Attorney J. Gregory Bowman will represent the United States.
