U.S. Attorney’s Office August 17, 2011
  • Eastern District of North Carolina (919) 856-4530

RALEIGH—United States Attorney Thomas G. Walker announced that in federal court yesterday United State District Judge James C. Dever III, sentenced ROBERT A. CARTER, JR., 26, of Fort Bragg, North Carolina, to 40 months’ imprisonment followed by three years’ supervised release.

A criminal information was filed on March 7, 2011, charging assault on a minor. That day, CARTER pled guilty to the charge.

According to the investigation, sometime between August 3, 2010, and August 9, 2010, CARTER, the spouse of an active-duty soldier who was living on the Fort Bragg military reservation, violently shook his 6-month-old baby. The active-duty military mother, who had been away training at the time, arrived home and noticed that the baby was not acting right and had a seizure. She then took the baby to the hospital. Upon examination and conduction of medical tests, it was learned that the baby was suffering from a sub-arachnoid hemorrhage. The baby was then flown to the Neonatal Intensive Care Unit at UNC Medical Center.

Investigation of this case was conducted by the United States Criminal Investigation Division - Fort Bragg and the Federal Bureau of Investigation. Special Assistant United States Attorney (Captain) Jamal A. Rhinehardt served as prosecution for the government.
