Federal Agents Search the Derby, New York Home of Shane Buczek, Arrest Buczek on Bail Violation Allegations

BUFFALO, NY—United States Attorney Terrance P. Flynn announced that early this morning, January 16th, 2009, Special Agents of the Federal Bureau of Investigation, with the assistance of agents from other agencies, searched the 7335 Derby Road, Derby, New York home of Shane C. Buczek for evidence of a violation of the federal bank fraud statute. The agents also arrested Buczek based on allegations that he had violated conditions of release that the federal court had imposed when it released him on bail in March of 2008 by both committing the bank fraud violation while out on bail and by violating other conditions the Court had imposed on him when it set bail.

Assistant U.S. Attorney Anthony Bruce stated that Buczek, who is representing himself, made an appearance before Magistrate Judge H. Kenneth Schroeder, Jr. several hours after his arrest and was remanded to prison for a psychiatric evaluation of his competency to stand trial.

In the affidavit requesting the search warrant, an FBI agent alleged that Buczek had opened an account at Best Buy in Hamburg and then made a number of major purchases including a 52" flat screen TV, and washer and dryer, and then instructed HSBC to get the funds to pay off his $8,800 in appliance purchases by debiting a non-existent account at Depository Trust and Clearing Corporation, a commercial bank in New York City that clears stock and bond transactions for major stockbrokers, but does not have accounts with any individuals (including Buczek).

The agents who conducted the search seized most of the items Buczek had purchased from Best Buy. Mr. Bruce noted that the evidence pertaining to the bank fraud will be presented to the grand jury and that the investigation is ongoing.
