Rosebud Man Sentenced for Sexual Abuse

PIERRE, SD—United States Attorney Brendan V. Johnson announced that a Rosebud man charged with sexual abuse was sentenced on April 11, 2011, by United States District Judge Roberto A. Lange. Floyd Black Spotted Horse, age 43, was sentenced to 108 months of imprisonment, eight years of supervised release, and a special assessment of $100 to the Victim Assistance Fund.
Black Spotted Horse was indicted for sexual abuse by a federal grand jury on October 13, 2010. The charge relates to Black Spotted Horse knowingly engaging in and attempting to engage in a sexual act with a female, who at the time was incapable of apprising the nature of the conduct and was physically incapable of declining participation in the sexual act, on January 30, 2010, in Todd County.
This case was investigated by the Federal Bureau of Investigation and Rosebud Law Enforcement Services. Assistant United States Attorney Tim Maher prosecuted the case.
Black Spotted Horse was immediately turned over to the custody of the United States Marshal.
