FORT WAYNE, IN—The United States Attorney’s Office announced the following activity:

Pleas:

  • Naseem Khayyata, 32, of Indianapolis, Indiana, pled guilty before Magistrate Judge Roger Cosbey to the felony offense of making false statements in the application for a passport. Magistrate Cosbey is recommending that the district court accept the tendered guilty plea. Parties have 10 days in which to object to the magistrate judge’s recommendation. These charges were filed as a result of an investigation by the Department of State. This case is being prosecuted by Assistant United States Attorney Tina Nommay.
  • Michael Scott, 28, of Fort Wayne, Indiana, pled guilty before Magistrate Judge Roger Cosbey to the felony offense of use of a firearm during and in relation to a drug trafficking crime. Magistrate Cosbey is recommending that the district court accept the tendered guilty plea. Parties have 10 days in which to object to the magistrate judge’s recommendation. These charges were filed as a result of an investigation by the Drug Enforcement Administration and the by the Bureau of Alcohol, Tobacco, Firearms, and Explosives. This case is being prosecuted by Assistant United States Attorney Lovita Morris King.
  • Mark S. Morgan, 36, of Angola, Indiana, pled guilty before Magistrate Judge Roger Cosbey to the felony offense of embezzlement of union funds. Magistrate Cosbey is recommending that the district court accept the tendered guilty plea. Parties have 10 days in which to object to the magistrate judge’s recommendation. These charges were filed as a result of an investigation by the Department of Labor. This case is being prosecuted by Assistant United States Attorney Lovita Morris King.
  • Brian Jordan, 44, of Fort Wayne, Indiana, pled guilty before Magistrate Judge Roger Cosbey to the felony offense of possession with the intent to distribute marijuana. Magistrate Cosbey is recommending that the district court accept the tendered guilty plea. Parties have 10 days in which to object to the magistrate judge’s recommendation. These charges were filed as a result of an investigation by the Drug Enforcement Administration and the Fort Wayne Police Department. This case is being prosecuted by Assistant United States Attorney Tina Nommay.
  • Beth Ann Boger, 46, of Garrett, Indiana, pled guilty before Magistrate Judge Roger Cosbey to the felony offenses of wire fraud and income tax evasion. Magistrate Cosbey is recommending that the district court accept the tendered guilty plea. Parties have 10 days in which to object to the magistrate judge’s recommendation. These charges were filed as a result of an investigation by the Internal Revenue Service. This case is being prosecuted by Assistant United States Attorney Lesley Miller Lowery.

If convicted in court, any specific sentence to be imposed will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.

Dispositions:

  • John Edward Scott, 50, of Fort Wayne, Indiana, was sentenced by Judge Theresa Springmann to 120 months’ imprisonment and eight years of supervised release after pleading guilty to the felony offense of possession with the intent to distribute cocaine. According to an Opinion and Order entered by the court in this case, a confidential informant made two controlled buys of heroin from a dealer who obtained the heroin from Scott’s residence. Based on these buys, detectives obtained a search warrant for Scott’s residence. Upon searching Scott’s bedroom, agents found 434.7 grams of marijuana, 928.13 grams of cocaine, 3.0 grams of heroin, and a loaded Hi-Point 9mm handgun. This case was the result of an investigation by the Federal Bureau of Investigation Safe Streets Task Force. This case was prosecuted by Assistant United States Attorney Anthony Geller.
  • James K. Ray, 51, of Fort Wayne, Indiana, was sentenced by Judge Theresa Springmann to 94 months’ imprisonment and three years of supervised release after pleading guilty to the felony offense of possession of a firearm as a convicted felon. This case was the result of an investigation by the by the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Fort Wayne Police Department. This case was prosecuted by Assistant United States Attorney Anthony Geller.
  • Jennifer McClurg, 43, of Fort Wayne, Indiana, was sentenced by Judge Theresa Springmann to 24 months’ imprisonment and one year of supervised release after pleading guilty to the felony offense of maintaining a place for the purpose of manufacturing marijuana and possessing with the intent to distribute marijuana. This case was the result of an investigation by the Drug Enforcement Administration and the Allen County Police Department. This case was prosecuted by Assistant United States Attorney Lovita Morris King.
