Two Jemez Men Sentenced on Federal Assault Convictions

This morning, United States District Judge William P. Johnson sentenced Tyler Sando, 20, and Frederick Gachupin, 21, both enrolled members of the Pueblo of Jemez, to terms of imprisonment based on federal assault convictions. Sando was sentenced to 27 months’ imprisonment and Gachupin was sentenced to 24 months’ imprisonment. Sando also was sentenced to an additional six months’ imprisonment on a felony child abuse conviction; Sanod's six-month sentence is to run consecutive to his 27-month sentence for a total prison sentence of 33 months. Each defendant will serve a three-year term of supervised release after he completes his prison sentence.

United States Attorney Kenneth J. Gonzales said Sando and Gachupin were indicted on June 24, 2010 and jointly charged with assaulting Cletis Chavez, also a member of the Pueblo of Jemez, on August 29, 2008 and causing Mr. Chavez serious bodily injury. Sando was arraigned on the indictment on July 1, 2010. At the time, Sando was in federal custody on another charge and remained in custody pending trial. On September 27, 2010, Sando entered guilty pleas to the assault charge and to the additional felony charge of abandoning or abusing a child.

Gachupin was arrested on July 7, 2010 and was released on conditions pending trial. On September 27, 2010, Gachupin entered a guilty plea to the assault charge and was remanded into custody pending sentencing.

The case was prosecuted by Assistant United States Attorney Kyle T. Nayback and was investigated by the Pueblo of Jemez Police Department and the Federal Bureau of Investigation.
