Defendant Who Unlawfully Possessed a Firearm Pleads Guilty
Cohoes Man Admits to Possessing a Rifle After Having Been Convicted of a Felony

ALBANY, NY—United States Attorney Richard S. Hartunian and Clifford C. Holly, Special Agent in Charge, Federal Bureau of Investigation, Albany Division, announced that Timothy Hoffman, age 55, of Cohoes, New York, pled guilty today in United States District Court in Albany before District Judge Mae A. D’Agostino to one count of possessing a firearm while being a prohibited person.
Pursuant to a written plea agreement, Hoffman admitted that on September 27, 2005, he was convicted in Albany County Court of grand larceny in the third degree, a felony offense. Hoffman further admitted that on February 2, 2012, he possessed, in Troy, New York, a Ruger .22 caliber rifle. By virtue of Hoffman’s prior felony conviction, he could not lawfully possess any firearms.
Sentencing was scheduled by Judge D’Agostino for September 24, 2012 at 11:00 a.m. in U.S. District Court in Albany, New York. Hoffman faces a maximum sentence of 10 years’ imprisonment. Hoffman was released pending his sentencing.
