Conrad Joseph Old Horn, Jr. Sentenced in U.S. District Court

The United States Attorney's Office announced that during a federal court session in Great Falls on January 27, 2011, before U.S. District Judge Sam E. Haddon, CONRAD JOSEPH OLD HORN, JR., a 28-year-old resident of Browning, appeared for sentencing. OLD HORN was sentenced to a term of:

• Prison: 51 months
• Special Assessment: $100
• Supervised Release: three years

OLD HORN was sentenced in connection with his guilty plea to assault resulting in serious bodily injury.

In an offer of proof filed by Assistant U.S. Attorney Vince Carroll, the government stated it would have proved at trial the following:

On February 14, 2010, at approximately 6:10 p.m., an assault at a residence in Browning was reported. BIA Police officers responded to the call. Upon arriving at the residence, the officers found a female individual, F.A.W., crying loudly and holding a blood-covered towel over her face. Upon further investigation, it was learned that the female's son, OLD HORN, had hit her in the face twice with his fists and hit her in the head with a telephone.

Witnesses who were all present at the residence at the time of the incident would have testified that on the morning of February 14, 2010, OLD HORN was at his mother's home, where he was living at the time. He had purchased a pint of vodka and had become drunk. OLD HORN was invited to join the rest of the family for a Valentine's Day dinner but refused the invitation. Later in the evening, OLD HORN's mother and her husband were in their bedroom getting ready to go to dinner, when OLD HORN came into the room and, among other things, asked to borrow money from his mother. She told OLD HORN to pack his things and leave. He refused and she attempted to call the police. OLD HORN then punched her twice in the face with his fists, and then hit her in the face with the telephone.

The victim was treated for her injuries at the Blackfeet Community Hospital. The treating physician indicated that the victim's injuries included "severe facial trauma and contusions, a fracture of the floor and medial wall of the left orbit, an ocular muscle protruding into the fracture; Also fracture of the left maxillary sinus [and] epistaxis nares." The doctor also indicated that the victim's injuries constituted serious bodily injury.

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that OLD HORN will likely serve all of the time imposed by the court. In the federal system, OLD HORN does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15 percent of the overall sentence.
