Randall Not Afraid Pleads Guilty in U.S. Federal Court

The United States Attorney’s Office announced that during a federal court session in Billings, on August 17, 2011, before Senior U.S. District Judge Jack D. Shanstrom, RANDALL NOT AFRAID, a 42-year-old resident of Lodge Grass, pled guilty to threat via interstate communication. Sentencing has been set for November 16, 2011. He is currently released on special conditions.
In an Offer of Proof filed by Assistant U.S. Attorney Vince Carroll, the government stated it would have proved at trial the following:
On January 13, 2011, a Bureau of Indian Affairs police officer and several Crow Tribal police officers responded to a domestic violence call at NOT AFRAID’s residence near Lodge Grass on the Crow Indian Reservation. It was reported that NOT AFRAID had assaulted his common-law wife.
Before the officers arrived at the residence, NOT AFRAID contacted the BIA Dispatcher, via telephone, and stated that he did not want officers at his home, and that he would shoot the officers if they came to his home. This telephone call was transmitted in interstate commerce.
NOT AFRAID faces possible penalties of five years in prison, a $250,000 fine and three years’ supervised release.
The investigation was conducted by the Federal Bureau of Investigation.
