Joe Robert Martinez Sentenced in U.S. District Court

The United States Attorney’s Office announced that during a federal court session in Great Falls on July 7, 2011, before U.S. District Judge Sam E. Haddon, JOE ROBERT MARTINEZ, a 39-year-old resident of California, appeared for sentencing. MARTINEZ was sentenced to a term of:
Prison: 32 months
Special Assessment: $100
Supervised Release: Five years
MARTINEZ was sentenced in connection with his guilty plea to abusive sexual contact.
In an offer of proof filed by Assistant U.S. Attorney Marcia K. Hurd, the government stated it would have proved at trial the following:
MARTINEZ was residing on the Fort Peck Indian Reservation where he worked at a local restaurant. MARTINEZ became friends with another man who worked there and spent some time at the man’s home in Wolf Point.
On October 24, 2009, while intoxicated, MARTINEZ went to the friend’s home. At some point, he went to the back bedroom where two minor females, then aged 5, were playing. MARTINEZ sexually abused the minor children. Shortly thereafter, MARTINEZ left the Fort Peck Indian Reservation and moved to California. When interviewed, both young girls disclosed the abuse.
Because there is no parole in the federal system, the “truth in sentencing” guidelines mandate that MARTINEZ will likely serve all of the time imposed by the court. In the federal system, MARTINEZ does have the opportunity to earn a sentence reduction for “good behavior.” However, this reduction will not exceed 15 percent of the overall sentence.
