Jocelynne Nicole Wheeler Sentenced in U.S. District Court

The United States Attorney’s Office announced that during a federal court session in Missoula, on June 3, 2011, before U.S. District Judge Donald W. Molloy, JOCELYNNE NICOLE WHEELER, a 26-year-old resident of Bellevue, Washington, appeared for sentencing. WHEELER was sentenced to a term of:
Prison: 46 months, concurrent with a Washington state sentence
Special Assessment: $100
Restitution: $8,354.41
Supervised Release: five years
WHEELER was sentenced in connection with her guilty plea to robbery involving controlled substances.
In an offer of proof filed by Assistant U.S. Attorney Tara J. Elliott, the government stated it would have proved at trial the following:
On March 29, 2010, at approximately 8:50 p.m., WHEELER robbed a pharmacy located in the rear of a Safeway store in Missoula. WHEELER brandished a pistol, demanded Oxycontin, and handed over a note to the pharmacist. The pharmacist handed over approximately $5,000 of Oxycontin. WHEELER’s fingerprints were recovered from the note. During interviews with law enforcement, WHEELER eventually admitted to committing the robbery.
Because there is no parole in the federal system, the truth in sentencing guidelines mandate that WHEELER will likely serve all of the time imposed by the court. In the federal system, WHEELER does have the opportunity to earn a sentence reduction for good behavior. However, this reduction will not exceed 15 percent of the overall sentence.
