Wagner Man Pleads Guilty to Assault Charge

SIOUX FALLS, SD—U.S. Attorney Brendan V. Johnson announced that Frank Fisher, Jr., age 24, of Wagner, appeared before Chief U.S. District Judge Karen E. Schreier on February 23, 2011, and pled guilty to one count of an indictment that charged him with assault with a dangerous weapon. The maximum penalty upon conviction is 10 years of imprisonment, a $250,000 fine, or both.

Fisher got into an argument with the victim and assaulted her several times, causing serious injury. The investigation was conducted by the FBI and Yankton BIA Law Enforcement Services. The case is being prosecuted by Assistant U.S. Attorney Thomas J. Wright.

A presentence investigation was ordered, and a sentencing date was set for May 20, 2011. The defendant was remanded to the custody of the U.S. Marshal pending sentencing.
