Federal Grand Jury in Fort Wayne Returns Indictments

FORT WAYNE, IN—The United States Attorney’s Office announced that a grand jury sitting in Fort Wayne, Indiana, returned the following Indictments on January 25, 2012:

Sergio Alvarez-Arellano, 25, of Warsaw, Indiana, is charged in a single-count indictment with possession with the intent to distribute a controlled substance on or about January 17, 2012. This charge was filed as the result of an investigation by the Federal Bureau of Investigation, Safe Streets Task Force, Indiana State Police, Fort Wayne Police Department, and the Allen County Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Anthony W. Geller.

Anna Deck, 30, of Fort Wayne, Indiana, is charged in a single-count indictment with possession with the intent to distribute a controlled substance on or about October 11, 2011. This charge was filed as the result of an investigation by the Drug Enforcement Administration, United States Postal Inspection Service and the Allen County Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Lesley J. Miller Lowery.

Michael L. Flores, 25, of Fort Wayne, Indiana, is charged in a single-count indictment with being a felon in possession of a firearm on or about October 27, 2011. This charge was filed as the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Fort Wayne Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Lesley J. Miller Lowery.

Francisco Garcia-Hernandez, 34, of Fort Wayne, Indiana, is charged in a 10-count indictment with distribution of controlled substances on or about September 27, 2011, September 29, 2011, November 23, 2011, November 29, 2011, December 5, 2011, December 9, 2011, December 15, 2011, December 22, 2011, December 23, 2011, and January 17, 2012. This charge was filed as the result of an investigation by the Federal Bureau of Investigation, Safe Streets Task Force, Indiana State Police, Fort Wayne Police Department and the Allen County Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Anthony W. Geller.

Jermorris T. Sewell, 28, of Fort Wayne, Indiana, is charged in three counts of a nine-count superseding indictment with conspiracy to distribute and possession with intent to distribute controlled substances from on or about February 10, 2010, and continuing until on or about January 29, 2011, maintaining a drug involved premises between on or about February 10, 2010, and on or about November 9, 2010, and possession with the intent to distribute a controlled substance on or about April 13, 2011.

Antonio T. Sewell, 30, of Fort Wayne, Indiana, is charged in two counts of a nine-count superseding indictment with conspiracy to distribute and possession with intent to distribute controlled substances from on or about February 10, 2010, and continuing until on or about January 29, 2011, maintaining a drug involved premises between on or about February 10, 2010, and on or about November 9, 2010.

Jose A. Soto, 28, of Fort Wayne, Indiana, is charged in three counts of a nine-count superseding indictment with conspiracy to distribute and possession with intent to distribute controlled substances from on or about February 10, 2010, and use of a communication facility on or about October 12, 2010 and October 14, 2010.

Willie James Brooks, 48, of Fort Wayne, Indiana, is charged in four counts of a nine-count superseding indictment with conspiracy to distribute and possession with intent to distribute controlled substances from on or about February 10, 2010, and continuing to January 29, 2011, and use of a communication facility on or about October 13, 2010, November 17, 2010, and January 12, 2011.

Brenna Underwood, 26, of Fort Wayne, Indiana, is charged in two counts of a nine-count superseding indictment with conspiracy to distribute and possession with intent to distribute controlled substances from on or about February 10, 2010, and continuing until on or about January 29, 2011, and profiting from maintaining a drug involved premises between on or about April 7, 2010, and on or about January 29, 2011.

The superseding indictment also seeks for forfeiture. These charges were filed as the result of an investigation by the Federal Bureau of Investigation, Fort Wayne Safe Streets Task Force, Indiana State Police, Fort Wayne Police Department, Allen County Police Department, Allen County Drug Task Force and the New Haven Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Anthony W. Geller and Lesley Miller Lowery.

The specific sentence in each case to be imposed upon conviction will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.

The United States Attorney’s Office emphasized that an Indictment is merely an allegation and that all persons charged are presumed innocent until and unless proven guilty in court.
