Doctor Charged with Prescription Fraud

Ferdinand B. Aczon, M.D. was charged today by Information with attempting to obtain a controlled substance by fraud, announced United States Attorney Zane David Memeger. According to the information, the defendant signed and issued a prescription for Tussionex, a Schedule III controlled substance, in the name of a person whom the defendant had never met or examined, and for whom the prescription was neither intended nor medically necessary, and unlawfully provided that prescription to another person known to the United States Attorney.

If convicted, the defendant faces a maximum possible sentence of four years’ imprisonment, a three-year period of supervised release, a $250,000 fine, and a $100 special assessment.
The case was investigated by the Federal Bureau of Investigation and is being prosecuted by Assistant United States Attorney John J. Pease.
