Winnebago Man Sentenced for Assault Resulting in Serious Bodily Injury

United States Attorney Deborah R. Gilg announced that on October 22, 2012, Chief United States District Court Judge Laurie Smith Camp sentenced Anthony Whitewater, age 20, of Winnebago, Nebraska, for his convictions for assault resulting in serious bodily injury and violation of supervised release. Whitewater was sentenced to 41 months’ incarceration for the assault and an additional six months for his violation of the terms of his supervised release. Judge Smith Camp further ordered that Whitewater serve three years on supervised release following his release from prison and that he pay $1,000 in restitution.

Whitewater had been convicted in the United States District Court for the District of Nebraska on April 11, 2011, of assault resulting in serious bodily injury. Following his incarceration for that offense, Whitewater was placed on supervised release on April 18, 2012. On April 21, 2012, Whitewater got into a fight at a residence on the Winnebago Indian Reservation. As Whitewater ran away from the scene of the fight, he encountered the next door neighbor who had walked to the end of his driveway to see what the disturbance was about. Whitewater struck the neighbor in the face with a broom handle or similar object, causing the neighbor to suffer a blowout fracture of the orbital floor of his eye socket.

This case was investigated by the FBI.
