San Francisco Man Sentenced to 21 Months in Prison for Making Threats Against the Family of an Elected Government Official

SAN FRANCISCO—Gregory Lee Giusti, 48, of San Francisco was sentenced today to 21 months in federal prison for making threats against the family of an elected United States official, announced United States Attorney Melinda Haag.

Giusti was charged by criminal complaint and made his initial appearance in United States District Court on April 8. He was indicted on April 15 with one count of making harassing and threatening telephone calls in interstate commerce, in violation of 47 U.S.C. § 223(a)(1)(C). A Superseding Information filed on Sept. 15 charged Giusti with intending to impede, intimidate, and interfere with a United States official by threatening or intimidating the official’s family member, in violation of 18 U.S.C. § 115(a)(1)(A). Giusti pled guilty to that charge in federal court in San Francisco on Sept. 16.

Following the terms of the plea agreement entered into by the defense counsel and the U.S. Attorney’s Office, today’s sentence was handed down by U.S. District Court Judge Jeffrey S. White. Judge White also sentenced the defendant to a three year term of supervised release and ordered the defendant to stay from the victim, the victim’s family and the victim’s residence, along with others.

Assistant United States Attorney Cynthia Frey is attorney who prosecuted the case, with the assistance of Assistant United States Attorney Gregg Lowder and legal assistant Rosario Calderon. The prosecution is the result of an investigation by the FBI and the United States Capitol Police.
