Thomas Green Jr. Pleads Guilty to Child Exploitation Offenses

SAN JOSE, CA—Pursuant to a plea agreement, Thomas Edward Green Jr., of San Jose, pleaded guilty yesterday to two felony counts of transmitting and possessing child pornography, United States Attorney Joseph P. Russoniello announced. Green is the director of finance for an area hospital.

In pleading guilty, Green admitted that from at least January 9, 2006, through November 9, 2006, he knowingly sent at least 67 emails containing visual depictions of minors and prepubescent minors engaged in sexually explicit conduct, including sadistic and masochistic conduct. Green traded child pornography by visiting various AOL chatrooms. He then sent and received, via his AOL account, the images of child pornography with the individuals he met online.

Green admitted that he possessed and distributed images depicting children under 10-years of age engaged in sexually explicit conduct, including, among others, pictures of prepubescent girls being sexually abused by adult men. To date, at least 10 children have been identified from the images found in Green’s possession.

The plea agreement provides for a sentence of imprisonment of at least five years, and up to the maximum statutory penalty of 20 years imprisonment. The maximum fine is $250,000. The sentence will be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553. Sentencing has been set for Jun 1, 2009.  Over the government’s objection, Green was permitted to remain free on bond pending sentencing.

“Those who trade images of child pornography online are promoting and condoning the sexual abuse of children, and, in many cases, cause ongoing trauma to the child victims,” Russoniello said. “The prosecution of Mr. Green and the dozens of other men throughout the United States who have already been sentenced to long prison terms for this activity, we hope, will serve as a reminder to all of us that distributing child pornography is a serious crime and that those who victimize children this way will be prosecuted to the fullest extent of the law.”

A federal Grand Jury returned a nine count superseding indictment against Green on January 29, 2009. He was charged with five counts of transmitting child pornography, in violation of 18 U.S.C. § 2252(a)(1), three counts of receiving child pornography, in violation of 18 U.S.C. § 2252(a)(2), and one count of possessing child pornography, in violation of 18 U.S.C. § 2252(a)(4). Under the plea agreement, Green pled guilty to one count of transmitting and one count of possessing child pornography.

Assistant United States Attorney Daniel Kaleba and Special Assistant United States Attorney Chad Mandell prosecuted the case with the assistance of Susan Kreider. The prosecution is the result of an investigation by the Federal Bureau of Investigation.
