Former CBP Officer Indicted for Bribery

BROWNSVILLE, TX—Javier Cavazos, 50, and David De La Fuente, 22, have been indicted for bribery and conspiracy to unlawfully transport aliens, United States Attorney Tim Johnson announced today. Cavazos is a former Customs and Border Protection (CBP) officer, from Los Fresnos, Texas, while De La Fuente is a resident of San Benito, Texas.      

On or about Dec. 17, 2008, Cavazos accepted money from De La Fuente in exchange for providing admission stamps to a passport and form I-94W belonging to an individual who had not properly presented himself for admission into the United States. Cavazos and De La Fuente did knowingly and willfully conspire to transport and move, by means of a motor vehicle and by guiding on foot, an alien who had come to, entered and remained in the United States, in violation of law in furtherance of the alien’s illegal presence in the United States.

De La Fuente and Cavazos remain free on bond. The bribery of a public official charge carries a maximum penalty of 15 years in federal prison and a fine of $250,000 or three times the value of the item received. Conspiracy to transport aliens carries a maximum penalty of 10 years in federal prison and a potential fine of $250,000.

This case is being investigated by Immigration and Customs Enforcement – Office of Professional Responsibility and the FBI and is being prosecuted by Assistant United States Attorney William Hagen.
