Kendall Wolcott Sentenced in U.S. District Court

The United States Attorney’s Office announced that during a federal court session in Billings on December 12, 2012, before Chief U.S. District Judge Richard F. Cebull, Kendall Wolcott, a 49-year-old resident of Lame Deer, appeared for sentencing. Wolcott was sentenced to a term of:
- Prison: 46 months
- Special assessment: $100
- Supervised release: 10 years
Wolcott was sentenced in connection with his guilty plea to abusive sexual contact.
In an Offer of Proof filed by Assistant U.S. Attorney E. Vincent Carroll, the government stated it would have proved at trial the following:
On August 8, 2011, the victim’s mother reported to the Yellowstone County Sheriff’s Office that her daughter was sexually abused by Wolcott when the victim was 9 years old. The victim made the disclosure during a “good touch/bad touch” discussion that the victim was overhearing between the victim’s mother and the victim’s younger step-sister. The victim disclosed, among other things, that Wolcott touched her on her vagina area while they were driving to Lame Deer when the victim was approximately 9 years old. The victim stated that they were near the town of Busby when this incident took place.
The victim is an enrolled member of the Crow Tribe of Indians.
Because there is no parole in the federal system, the “truth in sentencing” guidelines mandate that Wolcott will likely serve all the time imposed by the court. In the federal system, Wolcott does have the opportunity to earn a sentence reduction for “good behavior.” However, this reduction will not exceed 15 percent of the overall sentence.
