Anthony Rodriguez Sentenced in U.S. District Court

The United States Attorney’s Office announced that during a federal court session in Billings, on April 14, 2010, before Chief U.S. District Judge Richard F. Cebull, ANTHONY RODRIGUEZ, a 48-year-old resident of Billings, appeared for sentencing. RODRIGUEZ was sentenced to a term of:
- Prison: 300 months
- Special Assessment: $200
- Supervised Release: eight years
RODRIGUEZ was sentenced in connection with his guilty plea to distribution of methamphetamine.
In an Offer of Proof filed by Assistant U.S. Attorney James E. Seykora, the government stated it would have proved at trial the following:
On August 22, 2006, RODRIGUEZ sold 55.7 grams of a mixture of meth (31 percent pure, or 17.2 grams of actual methamphetamine) to an FBI cooperating witness for $4,000 at his residence in Billings.
On August 29, 2006, RODRIGUEZ sold 83.0 grams of a mixture of meth (31percent pure, or 25.70 grams of actual methamphetamine) to an FBI cooperating witness for $6,000 at his residence at in Billings.
On August 26, 2008, RODRIGUEZ was arrested on a federal warrant. RODRIGUEZ had $2,127 in cash and 20.10 grams of a mixture of methamphetamine (48.3 percent pure, or 9.70 grams of actual) in his possession.
Because there is no parole in the federal system, the “truth in sentencing” guidelines mandate that RODRIGUEZ will likely serve all of the time imposed by the court. In the federal system, RODRIGUEZ does have the opportunity to earn a sentence reduction for “good behavior.” However, this reduction will not exceed 15 percent of the overall sentence.
