Inmate Pleads Guilty to Assaulting Correctional Officer at Federal Prison

SACRAMENTO-- Acting United States Attorney Lawrence G. Brown announced today that JUAN VILLANUEVA-MACHADO, 33, an inmate at Federal Correctional Institution-Herlong, pleaded guilty today before United States Magistrate Judge Gregory G. Hollows to assaulting a federal prison correctional officer.
This case is the product of an investigation by the Federal Bureau of Investigation.
According to Assistant United States Attorney S. Robert Tice-Raskin, who is prosecuting the case, on January 24, 2008, VILLANUEVA-MACHADO, while being advised regarding his daily work assignment, swore at a senior officer at FCI-Herlong. Then, using his fist, he struck the officer’s left arm.
Under the terms of his plea agreement, VILLANUEVA-MACHADO has agreed to be sentenced to one year of incarceration, consecutive to his current prison term.
Sentencing is set for April 13, 2009, at 9:00 a.m. before Magistrate Judge Hollows. The maximum statutory penalty for the count of conviction is one year and a fine of $200,000. However, the actual sentence will be dictated by the Federal Sentencing Guidelines, which take into account a number of factors, and will be imposed at the discretion of the court.
