Fourteen Individuals Sentenced in Federal Court

MARTINSBURG, WV—Fourteen individuals were sentenced this week in United States District Court in Martinsburg by Chief Judge John Preston Bailey.

United States Attorney William J. Ihlenfeld, II announced that:

TIFFANY NICOLE JONES, age 33, of Martinsburg, West Virginia, was sentenced on October 17, 2011, to 60 months’ imprisonment to be followed by four years of supervised release. JONES was convicted on April 27, 2011, on one count of an Indictment charging her with the distribution of 13.5 grams of “crack” cocaine on April 10, 2008, in Martinsburg. JONES who is free on bond, will self report to the designated federal institution. The case was prosecuted by Assistant United States Attorney Thomas O. Mucklow and was investigated by the Eastern Panhandle Drug & Violent Crime Task Force, consisting of officers from the West Virginia State Police - Bureau of Criminal Investigation, the Martinsburg Police Department, the Berkeley County Sheriff’s Department, and the Jefferson County Sheriff’s Department.

RASHID DAYSHAWN ROBINSON a/k/a “DAY DAY,” age 33, of Martinsburg, was sentenced on October 18, 2011, to 151 months’ imprisonment to be followed by four years of supervised release. ROBINSON entered a plea of guilty on June 30, 2011, to one count of an indictment charging him with the distribution of “crack” cocaine on November 17, 2009, in Berkeley County, West Virginia. ROBINSON was remanded to the custody of the United States Marshal pending designation to a federal institution. The case was prosecuted by Assistant United States Attorney Erin K. Reisenweber and was investigated by the Eastern Panhandle Drug & Violent Crimes Task Force.

JONATHAN FREDERICK BENNETT a/k/a “WATER,” age 42, of Martinsburg, was sentenced on October 18, 2011, to 30 months’ imprisonment to be followed by six years of supervised release. BENNETT entered a plea of guilty on June 3, 2010, to one count of an indictment charging him with the distribution of “crack” cocaine on January 13, 2011, in Martinsburg. BENNETT was remanded to the custody of the United States Marshal pending designation to a federal institution. The case was prosecuted by Assistant United States Attorney Erin K. Reisenweber and was investigated by the Eastern Panhandle Drug & Violent Crime Task Force, consisting of officers from the West Virginia State Police - Bureau of Criminal Investigation, the Martinsburg Police Department, the Berkeley County Sheriff’s Department, and the Jefferson County Sheriff’s Department.

DERICK W. MARKLEY, age 27, of Martinsburg, was sentenced on October 18, 2011, to seven months’ imprisonment to be followed by three years’ supervised release, with the first three months of his supervision to be served on home confinement with electronic monitoring. MARKLEY entered a plea of guilty on June 2, 2011, to one count of an indictment charging him with the distribution of cocaine on December 12, 2007, in Martinsburg. MARKLEY was remanded to the custody of the United States Marshal pending designation to a federal institution. The case was prosecuted by Assistant United States Attorney Thomas O. Mucklow and was investigation by the Eastern Panhandle Drug & Violent Crime Task Force. The Task Force consists of officers from the West Virginia State Police - Bureau of Criminal Investigation, the Martinsburg Police Department, the Berkeley County Sheriff’s Department, and the Jefferson County Sheriff’s Department.

ERIC VAN JOHNSON, age 40, of Martinsburg, was sentenced on October 18, 2011, to five years’ probation. JOHNSON entered a plea of guilty on July 7, 2011, to one count of an indictment charging him with the distribution of “crack” cocaine on April 7, 2011. The case was prosecuted by Assistant United States Attorney Thomas O. Mucklow and was investigation by the Eastern Panhandle Drug & Violent Crime Task Force. The Task Force consists of officers from the West Virginia State Police - Bureau of Criminal Investigation, the Martinsburg Police Department, the Berkeley County Sheriff’s Department, and the Jefferson County Sheriff’s Department.

CLARENCE NATHANIEL SMITH, age 61, of Charles Town, West Virginia, was sentenced on October 19, 2011, to 121 months’ imprisonment to be followed by three years of supervised release. SMITH entered a plea of guilty on May 18, 2011, to one count of an Indictment charging him with the distribution of cocaine base on May 26, 2010. SMITH, who is free on bond, will self-report to the designated federal institution on February 3, 2012. The case was prosecuted by Assistant United States Attorney Paul T. Camilletti and was investigated by the Charles Town Police Department and the Bureau of Alcohol, Tobacco, Firearms & Explosives.

JAMUS LEMARK REDMAN, age 44, of Martinsburg, West Virginia, was sentenced on October 19, 2011, to 100 months’ imprisonment to be followed by six years of supervised release. REDMAN entered a plea of guilty on July 7, 2011, to one count of an indictment charging him with possession with intent to distribute “crack” cocaine on April 7, 2011. REDMAN was remanded to the custody of the United States Marshal pending designation to a federal institution. The case was prosecuted by Assistant United States Attorney Thomas O. Mucklow and was investigated by the Eastern Panhandle Drug & Violent Crimes Task Force, consisting of officers from the West Virginia State Police - Bureau of Criminal Investigation, the Martinsburg Police Department, the Berkeley County Sheriff’s Department, and the Jefferson County Sheriff’s Department.

DANIEL THOMAS HOFF-HAYLES, age 26, of Martinsburg, was sentenced on October 19, 2011, to 70 months’ imprisonment to be followed by three years of supervised release. HOFF-HAYLES entered a plea of guilty on May 19, 2011, to one count of possession of firearms on February 22, 2010, in Berkeley County, after having been previously convicted of possession with intent to distribute marijuana in Garrett County, Maryland, which is a crime punishable by imprisonment for a term exceeding one year. As part of his plea, HOFF-HAYLES will forfeit the two firearms found in his possession. HOFF-HAYLES was remanded to the custody of the United States Marshal pending designation to a federal institution. The case was prosecuted by Assistant United States Attorney Erin K. Reisenweber and was investigated by the Eastern Panhandle Drug & Violent Crime Task Force and the Bureau of Alcohol, Tobacco, Firearms and Explosives. The Task Force consists of officers from the West Virginia State Police - Bureau of Criminal Investigation, the Martinsburg Police Department, the Berkeley County Sheriff’s Department, and the Jefferson County Sheriff’s Department.

JUAN ARNALDO GOMEZ-GARCIA, age 29, of Petersburg, West Virginia, was sentenced on October 19, 2011, to 70 months’ imprisonment to be followed by three years of supervised release. ARNALDO GOMEZ-GARCIA entered guilty pleas on June 15, 2011, to two counts of an indictment charging him with the distribution of less than 500 grams of cocaine in Petersburg and using and carrying a firearm during and in furtherance of a drug trafficking crime. As part of his plea, GOMEZ-GARCIA agreed to forfeit the following items, which were either used in the violations above or were purchased with the proceeds of the illegal activity: $924.00 in United States Currency; an Emerson 32” LCD HDTV; a Compaq Presario CQ62 laptop computer; a Kodak digital camera; and a 1995 Toyota Corolla automobile. GOMEZ-GARCIA was remanded to the custody of the United States Marshal pending designation to a Federal institution. The case was prosecuted by Assistant United States Attorney Thomas O. Mucklow and was investigated by the Potomac Highlands Drug & Violent Crime Task Force, consisting of officers from the Federal Bureau of Investigation, West Virginia State Police - Bureau of Criminal Investigations, and Mineral County Sheriff’s Department.

JOROY NIGEL TWYMAN a/k/a “ROY,” age 32, of Charles Town, was sentenced, on October 19, 2011, to 41 months’ imprisonment to be followed by three years of supervised release. TWYMAN entered a plea of guilty on May 31, 2011, to one count of an Indictment charging him with the distribution of “crack” cocaine on May 11, 2010. TWYMAN was remanded to the custody of the United States Marshal pending designation to a federal institution. The case was prosecuted by Assistant United States Attorney Paul T. Camilletti and was investigated by the Charles Town Police Department, the Ranson Police Department, and the Bureau of Alcohol, Tobacco, Firearms & Explosives.

GEORGE MILTON MCDUFFIE, also known as JAFFAR HUSSAIN, age 36, of Hyattsville, Maryland, was sentenced on October 19, 2011, to 30 months’ imprisonment, to be followed by three years of supervised release. MCDUFFIE entered a plea of guilty on July 5, 2011, to one count of an Indictment charging him with possession with intent to distribute “crack” cocaine on September 6, 2010. MCDUFFIE was remanded to the custody of the United States Marshal pending designation to a federal institution. The case was prosecuted by Assistant United States Attorney Paul T. Camilletti and was investigated by the Martinsburg Police Department

REGINA LYNN COLE a/k/a REGINA LYNN COLVIN, age 35, of Martinsburg, was sentenced on October 19, 2011, to 24 months’ imprisonment to be followed by three years of supervised release. COLE entered a plea of guilty on May 18, 2011, to one count of an indictment charging her with possession with intent to distribute cocaine on July 22, 2010. COLE, who is on bond, will self-report to the designated Federal Institution. The case was prosecuted by Assistant United States Attorney Thomas O. Mucklow and was investigated by the Eastern Panhandle Drug & Violent Crime Task Force and the Bureau of Alcohol, Tobacco, Firearms and Explosives. The Task Force consists of officers from the West Virginia State Police - Bureau of Criminal Investigation, the Martinsburg Police Department, the Berkeley County Sheriff’s Department, and the Jefferson County Sheriff’s Department.

LISA D. KIRK, age 28, of Winchester, Virginia, was sentenced on October 19, 2011, to 14 months’ imprisonment to be followed by one year of supervised release. KIRK entered a plea of guilty on May 20, 2011, to one count of an indictment charging her with acquiring and obtaining oxycodone by fraud and deception on December 28, 2008, while employed as a Registered Nurse at the VA Medical Center in Martinsburg. As part of her plea, KIRK agreed to surrender her nursing license in all jurisdictions in which she is licensed and further agrees not to apply for reinstatement of such licenses for a period of two years following suspension. KIRK was remanded to the custody of the United States Marshal pending designation to a federal institution. The case was prosecuted by Assistant United States Attorney Erin K. Reisenweber and was investigated by the United States Department of Veterans Affairs, Office of Inspector General, and the Martinsburg Veterans Affairs Medical Center’s Police Department.

DUANE CLARKE, age 39, of Hedgesville, West Virginia, was sentenced on October 20, 2011, to 68 months’ imprisonment to be followed by 10 years of supervised release. CLARKE entered a plea of guilty on April 22, 2011, to a one-count indictment charging him with possession of child pornography, which was located on two computer drives at his residence on September 22, 2009. CLARKE, who is currently free on bond, will self-report to the designated federal institution on December 27, 2011. The case was prosecuted by Assistant United States Attorney Paul T. Camilletti and was investigated by the Department of Homeland Security - Immigration and Customs Enforcement.
