Two Allenwood Inmates Charged After Assault

The United States Attorney’s Office for the Middle District of Pennsylvania announced the filing of an Information against two federal inmates who allegedly assaulted a third inmate at the Allenwood Federal Correctional Complex, Federal Correctional Institution, White Deer.

According to United States Attorney Peter J. Smith, the Information alleges that on July 20, 2010, Edward Martinez, age 25, formerly of Seattle, Washington, and Antonio Tovar, Jr., age 32, formerly of Roseville, California, assaulted another inmate by striking and hitting him and aiding and abetting one another in this act.

If convicted of engaging in an assault at a federal prison on exclusive federal territory each could face imprisonment for up to six months and a $10,000 fine.

The Federal Bureau of Investigation investigated this offense with the assistance of personnel from the Allenwood Federal Correctional Institution. An arraignment date will be set in the future before Magistrate Judge William Arbuckle, III. This case is assigned to Assistant United States Attorney Frederick E. Martin.

An Indictment or Information is not evidence of guilt but simply a description of the charge made by the Grand Jury and/or United States Attorney against a defendant. A charged Defendant is presumed innocent until a jury returns a unanimous finding that the United States has proven the defendant’s guilt beyond a reasonable doubt or until the defendant has pled guilty to the charges.
