Man Sentenced to 21 Months in Prison for Assault Resulting in Serious Bodily Injury

United States Attorney Joe Stecher and the FBI announce the following information for the attention of the media:

Event Triggering this Release: United States District Court Judge Laurie Smith Camp sentenced Donald Whitewater to 21 months in prison and three years of supervised release for his conviction of assault resulting in serious bodily injury. Whitewater was further ordered to pay restitution in the amount of $7,300.50. In the early morning hours on July 8, 2008, Whitewater’s ex-girlfriend was sleeping in her bed on the Winnebago Indian Reservation when she awoke to find Whitewater in her room. Whitewater wanted to know about her relationship with another man and he wanted to get back together with her. When the victim asked Whitewater to leave, he got angry and punched her in the face. The punch broke her nose in two places which required surgery to correct. Whitewater had previously been convicted in the Winnebago Tribal Court for various offenses relating to the ex-girlfriend, including disturbing the peace, domestic violence, failure to obey a no contact order and assault.

Crime(s) Charged and Potential Penalty (A CHARGE is merely an accusation and every defendant is presumed innocent until and unless proven guilty): Assault resulting in serious bodily injury in violation of 18 U.S.C. §113(a)(6). The maximum statutory penalty is ten years of imprisonment and/or a $250,000 fine and three years of supervised release.
