Bridgeton Man Charged with Distribution of Child Pornography

U.S. Attorney’s Office May 05, 2010
  • District of New Jersey (973) 645-2888

CAMDEN, NJ—A Bridgeton, New Jersey man was arrested today for allegedly distributing child pornography over the Internet, United States Attorney Paul J. Fishman announced.

Carl Timm, 55, is charged by Complaint with one count of distribution of child pornography, and is scheduled to make an initial appearance this afternoon before United States Magistrate Judge Joel Schneider.

According to the Complaint filed in Camden federal court:

In January 2010, Timm distributed child pornography via peer to peer (“P2P”) file sharing software to an undercover officer. A court-authorized search warrant led to the seizure of additional child pornography from Timm’s residence, including a tape of Timm fondling a prepubescent girl.

The charge of distributing child pornography carries a maximum potential penalty of 20 years in prison and a fine of up to $250,000.

In determining an actual sentence, the judge to whom the case is assigned would, upon a conviction, consult the advisory U.S. Sentencing Guidelines, which provide appropriate sentencing ranges that take into account the severity and characteristics of the offense, the defendant's criminal history, if any, and other factors. The judge, however, is not bound by those guidelines in determining a sentence. Parole has been abolished in the federal system. Defendants who are given custodial terms must serve nearly all that time.

U.S. Attorney Fishman credited special agents of the Federal Bureau of Investigation’s Newark Division, Franklin Township Resident Agency, under the direction of Special Agent in Charge Michael B. Ward, the New Jersey State Police Internet Crimes Against Children Task Force, the New Jersey Division of Criminal Justice, and the Cumberland County Prosecutor’s Office with the investigation leading to the arrest.

The government is represented by Assistant U.S. Attorney Jacqueline M. Carle of the Criminal Division in Camden.

The charges and allegations contained in the Complaint are merely accusations and the defendant is considered innocent unless and until proven guilty.

Anyone who had information which may be relevant to this case is encouraged to contact the Newark Division of the FBI at 973-792-3000.
