Oglala Man Charged with Murder

U.S. Attorney Brendan V. Johnson announced that a man has been indicted by a federal grand jury for murder.

Beau Dean Black Smith, age 20, of Oglala, was indicted by a federal grand jury on February 15, 2011, for murder. He appeared before U.S. Magistrate Judge Mark A. Moreno on February 17, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is any term of years up to lifetime imprisonment. The charge is merely an accusation, and Black Smith is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Federal Bureau of Investigation, the Bureau of Indian Affairs, and the Oglala Sioux Department of Public Safety. Assistant U.S. Attorney Carolyn G. Olson is prosecuting the case. Black Smith was remanded to the custody of the U.S. Marshal. A trial date has not yet been set.
