Second Fort Rice Man Pleads Guilty to Bar Burglary

BISMARCK—United States Attorney Timothy Q. Purdon announced that on December 1, 2010, Scott Nalley, 22, of Fort Rice, North Dakota, pleaded guilty before United States District Court Judge Patrick A. Conmy to a charge of burglary.

On May 19, 2010, around 4:30 a.m., Nalley and co-defendant Jeremy Will entered the T Bar 3 near Cannonball, North Dakota, by prying open the entry door with crow bars. Nalley and Will stole liquor, a television, money and other items from inside the building.

The charge of burglary carries a statutory maximum penalty of five years in federal prison and a $250,000 fine.

The case was investigated by the Federal Bureau of Investigation and Bureau of Indian Affairs - Standing Rock Agency.

Sentencing for Nalley has been scheduled for April 7, 2011, in United States District Court in Bismarck, North Dakota, at 11:00 a.m.

Will previously pleaded guilty and was sentenced on November 22, 2010, to three years and one month in federal prison to be followed by three years of supervised release.

Assistant United States Attorney Rick Volk is prosecuting the case.
