South Dakota Woman Pleads Guilty to Assaulting Law Enforcement Officer

United States Attorney Brendan V. Johnson announced that Kimbert Red Legs, age 44, of McLaughlin, appeared before United States District Judge Roberto A. Lange on December 1, 2010, and pled guilty to a superseding information that charged her with assaulting, resisting, or impeding a federal officer. The maximum penalty upon conviction is eight years in custody, a $250,000 fine, or both; three years of supervised release; and a $100 special assessment.

The charge relates to a July 24, 2010, incident at the junction of Highways 20 and 63 in Dewey County involving a Cheyenne River Sioux Tribe law enforcement officer, who was assaulted during the performance of his law enforcement duties by the defendant, Ms. Red Legs.

The investigation was conducted by the Federal Bureau of Investigation. The case is being prosecuted by Assistant United States Attorney Mikal Hanson.

A presentence investigation was ordered, and a sentencing date was set for February 28, 2011. The defendant was released on bond pending sentencing.
