Rapid City Man Pleads Guilty to Drug Charges

United States Attorney Brendan V. Johnson announced that Nicholaus Oliver Pearce, age 30, of Rapid City, South Dakota, appeared before United States District Judge Roberto A. Lange on November 22, 2010, and pled guilty to an indictment that charged him with conspiracy to distribute and possess with intent to distribute a controlled substance. The maximum penalty upon conviction is five years of imprisonment, a $250,000 fine, or both; up to three years of supervised release, and a $100 special assessment. Restitution may also be ordered.

The charge relates to Pearce conspiring with others to distribute and possess with intent to distribute marijuana in the District of South Dakota and elsewhere in 2007 and 2008. The investigation was conducted by the Northern Plains Safe Trails Drug Enforcement Task Force. The case is being prosecuted by Assistant United States Attorney Tim Maher.

A presentence investigation was ordered, and a sentencing date was set for February 14, 2011. The defendant was released on bond pending sentencing.
