Federal Firearms Charges Filed Against Man Who Shot at FBI Agents

KANSAS CITY, KS—Nicholas Henry, 26, is charged with one count of unlawful possession of a firearm after felony convictions, U.S. Attorney Lanny Welch said today.

A criminal complaint filed today in U.S. District Court in Kansas City, Kan., alleges that on Nov. 1, 2009, Henry attempted to avoid arrest by firing a handgun at members of the Federal Bureau of Investigation’s Violent Crimes Task Force. Because of previous felony convictions, Henry was prohibited from possessing a gun.

According to an agent’s affidavit, task force members spotted Henry with a Red Dodge pickup truck near 151st and Ridgeview Road in Olathe. Henry was wanted on outstanding warrants from Johnson County, and the truck had been reported stolen.

When task force members approached Henry, he ran to the stolen truck, removed a handgun and a bulletproof vest and began firing at them. They returned fire. He was arrested and treated for gunshot wounds.

Henry’s criminal record included convictions in Johnson and Douglas counties for burglary of a vehicle, forgery, attempted aggravated escape from custody, aggravated assault and felony theft.

The Federal Bureau of Investigation’s Violent Crime Task Force made the arrest. Assistant U.S. Attorney Tris Hunt is prosecuting.
