Activity in Federal Court – South Bend

SOUTH BEND, IN—The United States Attorney’s Office announced the following activity in Federal Court:

Martin Beserra, 32, of South Bend, Indiana, was sentenced by Judge Robert Miller, Jr. to 138 months’ imprisonment and four years of supervised release after pleading guilty to count 8 of an indictment charging him with distribution of five grams or more of cocaine. This case was investigated by Drug Enforcement Administration, and was prosecuted by Assistant United States Attorney Frank Schaffer.

Janice Rauch, 51, of Niles, Michigan, plead guilty before Magistrate Judge Christopher Nuechterlein to count one of an indictment charging her with wire fraud. On or about February 15, 2006, a relative wired money in the amount of $1,565 through a Western Union Money Transfer from Haleyville, Alabama to Rauch in South Bend, Indiana. This money was loaned to her because she told the relative she needed the money for expenses of her father’s estate when she knew that she was going to use the money for personal expenses. This case was investigated by Federal Bureau of Investigation, and is being prosecuted by Assistant United States Attorney Barbara Brook.

Eddie Lee Wade, Jr., 30, of South Bend, Indiana, plead guilty before Magistrate Judge Christopher Nuechterlein to count one of an indictment charging him with possession with the intent to distribute cocaine base. This case was investigated by the Drug Enforcement Administration, and is being prosecuted by Assistant United States Attorney Frank Schaffer.

Kenneth Ray Schacht, 38, of San Pierre, Indiana, plead guilty before Magistrate Judge Christopher Nuechterlein to count one of an indictment charging him with being an unlawful user of a controlled substance in possession of a firearm. This case was investigated by the Bureau of Alcohol, Firearms, Tobacco, and Explosives, and is being prosecuted by Assistant United States Attorney William Grimmer.

Fred Osborne, 43, of South Bend, Indiana, plead guilty before Magistrate Judge Christopher Nuechterlein to count one of an indictment charging him with being a felon in possession of a firearm. Osborne was previously convicted of robbery and drug trafficking. This case was investigated by the Bureau of Alcohol, Firearms, Tobacco, and Explosives, and is being prosecuted by Assistant United States Attorney Frank Schaffer.

Karen Glenn, 60, of Logansport, Indiana, plead guilty before Magistrate Judge Christopher Nuechterlein to count one of an indictment charging her with theft of government funds (Social Security Administration). Glenn admitted in a plea agreement that she applied for Social Security benefits in 2003. She reported to the Social Security Administration that she had been separated from her husband so that she could receive more benefits as a single person. In fact, she had not separated from her husband. As a result, she received $25,214.23 in Social Security benefits to which she was not entitled. This case was investigated by the Social Security Administration, and is being prosecuted by Assistant United States Attorney Jesse Barrett.

The specific sentence in each case to be imposed upon conviction will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.
