Federal Inmate Indicted for Assault

Timothy M. Morrison, United States Attorney for the Southern District of Indiana, announced that DAVID B. HEARNE, 30, a Federal Bureau of Prisons Inmate, was indicted by a federal grand jury sitting in Indianapolis for two counts of aggravated assault on a federal officer, following an investigation by the Federal Bureau of Investigation and the Bureau of Prisons.

The indictment alleges that HEARNE assaulted two correctional officers at the Federal Correctional Complex in Terre Haute, Indiana on November 7, 2008, resulting in bodily injury to each of the officers.

According to Assistant U. S. Attorney James M. Warden, who is prosecuting the case for the government, HEARNE faces a maximum possible prison sentence of 20 years and a maximum possible fine of $250,000 on each count. An initial hearing will be scheduled before a U.S. Magistrate Judge in Terre Haute, Indiana.

The indictment is an allegation only, and the defendant is presumed innocent unless and until proven guilty at trial or by guilty plea.
