Scenarios of Multiple Reasons Fingerprinted on a Single Civil Fingerprint Submission

During discussions following an update on the Adam Walsh Child Protection and Safety Act (Adam Walsh Act) at the November 2007 National Crime Prevention and Privacy Compact Council (Council) meeting, the Council requested FBI Compact staff to provide two scenarios when more than one reason fingerprinted may be stated on a single fingerprint submission. Two such scenarios are set forth below and are provided for the Council's information and discussion.

Scenario #1

The state’s chief executive officer has requested (and has been approved) to submit fingerprints of prospective foster parents for national criminal history record checks pursuant to Section 153 of the Adam Walsh Act. The state also has a state statute approved pursuant to Public Law (Pub. L.) 92-544 to check the background of prospective foster parents. Mr. Doe applies to become a foster parent through the Madison County Child Welfare Agency (a local governmental Authorized Recipient under Pub. L. 92-544). Prior to fingerprint submission, Mr. Doe also applies to become a foster parent with We Care, Inc. (a private company that is responsible under a contract with the Franklin County Child Welfare Agency for approving foster parents, both of which are Authorized Recipients of FBI criminal history record information (CHRI) pursuant to Section 153 of the Adam Walsh Act). The “Reason Fingerprinted” field on a single fingerprint submission to the FBI is completed as “Foster Parent, (Pub. L. 92-544 state statute citation)” and “Adam Walsh Act, Section 153(b)(1).” The fingerprint submission is channeled to the FBI through the State Identification Bureau (SIB). The results of the national criminal history record check is returned to the SIB. The SIB disseminates the results to the Madison County Child Welfare Agency and We Care, Inc., the private company located in Franklin County. The SIB logs the disseminations for audit purposes.

Scenario #2

The state’s chief executive officer has requested (and received approval) to submit fingerprints for national criminal history record checks of individuals under consideration for employment in private elementary or secondary schools in positions in which the individuals would work around children in the school, as authorized by Section 153 of the Adam Walsh Act. The state also has a state statute approved pursuant to Pub. L. 92-544 to check the backgrounds of applicants for a Realtor license.

Ms. Smith applies for a Realtor license through the State Board of Realtors (a state governmental agency and Authorized Recipient under Pub. L. 92-544). Prior to fingerprint submission, Ms. Smith also applies for a nurse position at the ABC School (a private elementary school and Authorized Recipient of FBI CHRI pursuant to Section 153 of the Adam Walsh Act). The “Reason Fingerprinted” field on a single fingerprint submission to the FBI is completed as “Realtor License, (Pub. L. 92-544 state statute citation)” and “Adam Walsh Act, Section 153(b)(2).” The fingerprint submission is channeled to the FBI through the SIB. The results of the national criminal history record check is returned to the SIB. The SIB disseminates the results to the State Board of Realtors and the ABC School. The SIB logs the disseminations for audit purposes.

Note:
In order for the “Reason Fingerprinted” field in a fingerprint submission to successfully pass the CJIS Division’s Automated Quality Check (Auto QC) review, it must contain the exact wording that is pre-programmed into the Auto QC Reason Fingerprinted table. When the fingerprint submission deviates (e.g., even a space or dash) from that already programmed into the Auto QC table, the submission will fail Auto QC review and be routed for manual review. Accordingly, it is expected that most fingerprint submissions containing more than one Reason Fingerprinted will require a manual QC review. However, if the same multiple Reasons Fingerprinted become a common practice, the state should contact the CJIS Division’s Biometric Services Section to arrange for the exact wording to be programmed into the Auto QC Reason Fingerprinted table.
