Port Lavaca Resident Sentenced on Charges of Possession and Receipt of Child Pornography

VICTORIA, TX—Roselio Garcia, 56, of Port Lavaca, Texas, has been sentenced to 135 months in the Bureau of Prisons for both possession and receipt of child pornography, United States Attorney Tim Johnson announced today. The sentence was pronounced today.

The investigation leading to the charges and Garcia’s subsequent conviction was initiated by the Corpus Christi Police Department (CCPD) after receiving information in 2008 from investigators at the Louisiana State Attorney General’s Office regarding several provocative photographs which included a truck bearing a Texas license plate. That license plate number lead CCPD and the FBI to identify Garcia as the registered owner of the truck. A search of Garcia’s house, where he lived with his wife and other members of his family, including young children, yielded a computer system and hard drive containing the child pornography.

When addressing the charges, the court noted the importance of trying to deter the defendant as well as others from possessing and distributing child pornography, commenting that Garcia had received almost every enhancement possible that applied to his offenses. Those included the young age of the children, transferring images for something of value, images that portrayed sadistic or masochistic conduct, the large number of images (in excess of 600 images) and the use of a computer for the possession, transmission, receipt or distribution of the child pornographic material.

Following completion of the 135-month term, the court further ordered Garcia serve 10 years on supervised release for possession and receipt of child pornography during which Garcia will be required to attend sex offender counseling and to register as a sex offender in the sex offender registry, may not own or have access to any device connected to the Internet, and must remain at least 100 feet away from schools, parks, and other recreational areas where children assemble.

The case was investigated by the CCPD and the FBI and was prosecuted by Assistant United States Attorney Carol Wheeler.
