Former Texas Man Sentenced to Over 33 Years in Prison for Producing Child Pornography

CHICAGO—A former Texas man was sentenced today to 400 months in federal prison for manufacturing child pornography. The defendant, Richard W. Fleming, 47, pleaded guilty in June 2010. According to his guilty plea, in 2001, Fleming traveled to Streator, Illinois, to produce images of a minor boy engaged in sexually explicit conduct. According to court filings, Fleming again traveled to Streator in 2003 to produce images of child pornography involving two additional boys.

The sentence was imposed by U.S. District Judge Robert W. Gettleman. Fleming must serve at least 85 percent of his sentence before he is eligible for release, and there is no parole in the federal prison system. After his release, Fleming is subject to a lifetime of supervised release. The sentence was announced today by Patrick J. Fitzgerald, United States Attorney for the Northern District of Illinois, and Robert D. Grant, Special Agent in Charge of the Chicago office of the Federal Bureau of Investigation.

Fleming has been in federal custody since June, 2007, when he was arrested by FBI agents in the Western District of Texas, where he lived at the time. Fleming was subsequently charged in the Western District of Texas with possession of child pornography, for which he was sentenced to 20 years’ imprisonment in November 2008. According to court documents, Fleming was identified by the FBI as an individual who traveled from Texas to Illinois to produce child pornography along with Charles Burt, who has previously been sentenced to 100 years’ imprisonment.
