Former Truck Driver Indicted on Charges of Transporting Minors for Sex

BUFFALO, NY—U.S. Attorney William J. Hochul, Jr. announced today that a federal grand jury in Buffalo has returned a four-count superseding indictment charging Kevin L. Donaldson, 45, of Salamanca, New York, with transportation of minors with the intent to have sex. The charges carry a mandatory minimum penalty of 10 years in prison and a maximum penalty of life, a fine of $250,000, or both.

Assistant U.S. Attorney Aaron J. Mango, who is handling the case, stated that Donaldson, a former truck driver, transported two minor victims across state lines and had sex with them while he was making deliveries in his truck. Specifically, with respect to Victim 1, the Indictment alleges that the defendant transported her in interstate commerce in April of 2006 and April of 2007, with the intent to have sex with her. With respect to Victim 2, the Indictment alleges that the defendant transported her in interstate commerce in April of 2004 and May of 2006, with the intent to have sex with her.

This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice. Led by United States Attorneys’ Offices and the Criminal Division's Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state, and local resources to better locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. The superseding indictment is the culmination of an investigation on the part of special agents of the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge James H. Robertson, and the Salamanca Police Department, under the direction of Chief Troy Westfall.

The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
