Atlanta Man Sentenced to Prison for Over Eight Years for Receiving Child Pornography

ATLANTA—PHILIP EMANUEL, 45, of Atlanta, Georgia, was sentenced late this afternoon by United States District Judge Charles A. Pannell, Jr. to serve over eight years in federal prison on a charge of receiving child pornography.

United States Attorney Sally Quillian Yates said of the case, “This case is especially egregious because within the defendant’s large collection of child pornography, law enforcement officers discovered pictures of a 10-year-old girl living in his neighborhood. The defendant edited the 10-year old girl’s pictures to appear as if she was engaging in sexual acts with him. This man’s actions show the importance of identifying and prosecuting those individuals who prey on children—in this case, in their own neighborhood.”

EMANUEL was sentenced to eight years and one month in prison to be followed by 20 years of supervised release, and fined $15,000. Restitution to the victim will be decided at a hearing tentatively scheduled for later this month before Judge Pannell. EMANUEL pled guilty to the charges on July 27, 2010.

According to United States Attorney Yates, the charges and other information presented in court: In May 2008, a detective with the Atlanta Police Department (APD) received information that EMANUEL possessed images of child pornography on his computer. EMANUEL admitted during an interview with APD detectives that he had a sexual addiction to viewing child pornography and that his computer contained child pornography. A subsequent search of EMANUEL’s computer by APD revealed over a thousand images of child pornography. Additionally, investigators discovered dozens of pictures of young girls photographed during what appeared to be a neighborhood Halloween trick-or-treat outing.

Investigators with APD were able to identify one of the young girls in the Halloween photographs as a 10-year-old girl living in EMANUEL’s neighborhood. EMANUEL's computer contained dozens of images in which the faces of young girls, including the 10-year-old girl were cropped onto the bodies of nude children that EMANUEL downloaded from the Internet. EMANUEL then edited those images by taking nude photographs of himself posed on a bed in various sexual positions and cropping the edited photographs to appear as if he was engaging in sexual acts with children, including the 10-year-old girl. When the 10-year-girl was interviewed she did not disclose any abuse by EMANUEL. The images recovered from EMANUEL's computer equipment were sent to the National Center for Missing and Exploited Children's Victim Identification Program, where many of the children depicted in the images were determined to be known victims of child exploitation.

This case is being brought as part of Project Safe Childhood. In February 2006, the Attorney General launched Project Safe Childhood, a nationwide initiative designed to protect children from online exploitation and abuse. Led by the United States Attorney's Offices around the country, Project Safe Childhood marshals federal, state, and local resources to apprehend and prosecute individuals who exploit children via the Internet.
