Glenmont Man Sentenced for Possession of Child Pornography

Andrew T. Baxter, Acting U.S. Attorney for the Northern District of New York, and John F. Pikus, Special Agent in Charge of the Federal Bureau of Investigation, Albany Division, announced that ROBERT C. MCCOY, age 49, of Glenmont, New York, was sentenced today by U.S. District Judge Gary L. Sharpe in Federal Court in Albany on his guilty plea to a count of an Indictment charging him with the possession of child pornography. MCCOY was sentenced to a 5 year term of probation, which includes a special condition requiring 6 months of home confinement. He also was ordered to (1) have no unsupervised contact with minors; (2) participate in a sex offender program; and (3) register with the New York State Sex Offender Registry Program. The court also ordered that computer equipment be forfeited to the United States.

MCCOY pled guilty on September 10, 2008. In connection with his plea, MCCOY admitted the following in a written plea agreement and during his plea proceeding:

At all times relevant herein, ROBERT C. MCCOY resided in Glenmont, New York, which is located in the Northern District of New York. On November 17, 2003, a federal search warrant was executed at his residence and a Pionex computer tower (s/n 7001877067) containing a Western Digital hard drive (s/n WMA6W1152254) and a CD writer was recovered from his bedroom. A forensic examination of this computer was subsequently conducted. Approximately 8 still images of female minors engaged in sexually explicit conduct, as those terms and phrases are defined in Title 18, United States Code, Section 2256(2), were recovered from said computer. These images, which had been saved in computer folders, depict 3 individuals under the age of 18 engaged in the lascivious exhibition of the genitals and pubic area. For example, one image depicts a 12-13 year old naked female laying on her back and facing the camera with her legs spread apart exposing her naked vaginal area. These images depict actual, as opposed to computer generated, images of minors engaged in such conduct. ROBERT C. MCCOY knowingly possessed the aforesaid computer and images located on his computer. In addition, he possessed the images knowing that they depict minors engaged in sexually explicit conduct. Moreover, such images, and the actual computer used to obtain and download them, were transported in interstate and foreign commerce and were produced using materials that had been mailed, or shipped or transported in interstate and foreign commerce.

The case was investigated by the Federal Bureau of Investigation and the Bethlehem Police Department.
