  • Northern District of California (415) 436-7200

SAN JOSE, CA—On May 18, 2011, Antonio Bates, of Anchorage, Alaska, pleaded guilty in federal district court to aggravated sexual abuse of a child under 12, United States Attorney MELINDA HAAG announced. These charges arise from the defendant’s sexual molestation of a minor while they lived on Fort Hunter-Liggett, a U.S. Army base in Monterey, California.

According to the plea agreement, the defendant admits that he sexually abused a minor from 1989 through 1996. During that time, the victim was 6 to 13 years of age. The abuse occurred not only in California, but also in Kansas and Germany, where the defendant was stationed during his military service.

Mr. Bates was arrested on November 19, 2010, in Anchorage, Alaska and has been in custody while he awaited trial in San Jose before the Honorable Lucy Koh, United States District Court Judge.

The maximum statutory penalty for the crime to which he pleaded guilty, 18 U.S.C. § 2241(c) aggravated sexual abuse with child under 12, is life imprisonment and a fine of $250,000. However, any sentence following conviction will be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553.

The defendant’s sentencing will be August 3, 2011 at 10 a.m. before Judge Koh.

Grant Fondo and Amber Rosen are the Assistant United States Attorneys prosecuting the case with the assistance of Kamille Singh. The prosecution is the result of an investigation by the Federal Bureau of Investigation.
