San Diego FBI Special Agent Keith Slotter announces the arrest of Patrick Porter, age 39, of Overland, Kansas, and the recovery of 16-year-old Jordan McKenzie Stuart.

Porter was taken into custody without incident at approximately 3:25 p.m. in the area of Mission Bay Drive, San Diego, California. Jordan McKenzie Stuart, who was the subject of an Amber Alert, was recovered at the same time. Porter was taken into custody by FBI agents, assisted by members of the San Diego Internet Crimes Against Children’s (ICAC) Task Force, and the Safe Team.

In a criminal complaint filed June 7, 2010, in U.S. District Court, District of Kansas, Kansas City, Kansas, Porter is charged with possessing child pornography and engaging in graphically sexual conversation with a minor in an attempt to convince the minor to engage in sexual acts with him.

It is anticipated that Porter will be booked into the Metropolitan Correctional Center (MCC) pending is initial appearance before a U.S. Magistrate Judge.

If convicted Porter faces a penalty of not less than 10 years and not more than life and a fine up to $250,000 on the charge of coercing a minor, and a maximum penalty of 10 years and a fine up to $250,000 on the child pornography charge.

An arrest itself is not evidence that the defendant committed crimes charged. The defendant is presumed innocent until the government meets its burden in court of proving guilt beyond a reasonable doubt.
