Colen James Gibson Sentenced in U.S. District Court

The United States Attorney's Office announced that during a federal court session in Billings on January 6, 2011, before Chief U.S. District Judge Richard F. Cebull, COLEN JAMES GIBSON, a 31-year-old resident of Billings, appeared for sentencing. GIBSON was sentenced to a term of:

Prison: time served (nine days)
Special Assessment: $100
Supervised Release: five years with six months in a pre-release center

GIBSON was sentenced in connection with his guilty plea to conspiracy to possess with intent to distribute or distribute methamphetamine.

Assistant U.S. Attorney James E. Seykora stated that the government would have proven at trial that GIBSON was involved with other individuals in a conspiracy to possess with the intent to distribute and the distribution of methamphetamine in Montana.

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that GIBSON will likely serve all of the time imposed by the court. In the federal system, GIBSON does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15 percent of the overall sentence.

The investigation was conducted by the Federal Bureau of Investigation's Big Sky Safe Streets Task Force, which includes the Billings Police Department and the Yellowstone County Sheriff's Office.
