Informational: Federal Court Arraignments

The United States Attorney's Office announced that during a federal court session in Great Falls on February 23, 2010, before U.S. Magistrate Judge Keith Strong, the following individuals were arraigned:
DAVID ALLEN McQUEEN, a 24-year-old resident of Great Falls, appeared on a charge of receipt of child pornography. He is currently detained. If convicted of this charge, McQUEEN faces possible penalties of a mandatory minimum of five years in prison and could be sentenced to 20 years, a $250,000 fine, and lifetime supervision. Assistant U.S. Attorney Cyndee L. Peterson is the prosecutor for the United States. The investigation was conducted by U.S. Immigration and Customs Enforcement.
DOUGLAS FLOYD MAIN, a 23-year-old resident of Fort Belknap, appeared on a charge of assault resulting in serious bodily injury. He is currently detained. If convicted of this charge, MAIN faces possible penalties of 10 years in prison, a $250,000 fine, and three years of supervised release. Assistant U.S. Attorney Rebekah J. French is the prosecutor for the United States. The investigation was a cooperative effort between Federal Bureau of Investigation and the Fort Belknap Tribal Police.
WILBIN JESSE JACKSON, a 31-year-old resident of Harlem, appeared on a charge of abusive sexual contact. He is currently detained. If convicted of this charge, JACKSON faces possible penalties of life in prison, a $250,000 fine, and a mandatory five years to life supervised release. Assistant U.S. Attorney Rebekah J. French is the prosecutor for the United States. The investigation was conducted by the Federal Bureau of Investigation.
SHELLEY DEVONNE PIPE, a 44-year-old resident of Wolf Point, and PAUL JAMES BEMER, age 41, DOLLY DIANE CROWE, age 45, ANGELITA MARIE HEADDRESS, age 27, EVADNA RUNNING BEAR, age 69, and CONNIE JEAN SMITH, age 51, residents of Poplar, appeared on charges of theft from an Indian tribal organization and obstruction of a federal audit. They are currently released on special conditions. If convicted of these charges, they each face possible penalties of five years in prison, a $250,000 fine, and three years of supervised release. Assistant U.S. Attorney Carl E. Rostad is the prosecutor for the United States. The investigation was conducted by the U.S. Department of the Interior - Inspector General's Office.
JAMES KEITH LABUFF, a 34-year-old resident of Browning, appeared on a charge of robbery. He is currently detained. If convicted of this charge, LABUFF faces possible penalties of 15 years in prison, a $250,000 fine, and three years supervised release. Assistant U.S. Attorney Vince Carroll is the prosecutor for the United States. The investigation was conducted the Federal Bureau of Investigation.
DEAN NECKLACE, a 35-year-old resident of Brockton, appeared on a charge of being a habitual domestic violence offender. He is currently detained. If convicted of this charge, NECKLACE faces possible penalties of five years in prison, a $250,000 fine, and three years of supervised release. Assistant U.S. Attorney Carl E. Rostad is the prosecutor for the United States. The investigation was a cooperative effort between the Federal Bureau of Investigation and the Fort Peck Tribes Criminal Investigation Division.
MARTIN RAY HOULE, a 31-year-old resident of Great Falls, appeared on a charge of conspiracy to possess with the intent to distribute cocaine, possession with the intent to distribute cocaine, and distribution of cocaine. He is currently detained. If convicted of these charges, HOULE faces possible penalties of a mandatory minimum of five years in prison and could be sentenced to 40 years, a $2,000,000 fine, and at least four years of supervised release. Assistant U.S. Attorney Joseph E. Thaggard is the prosecutor for the United States. The investigation was a cooperative effort between the Federal Bureau of Investigation and the Great Falls Police Department.
The defendants pled not guilty to the charges.
The charge, an indictment, information or complaint, is merely an accusation and all persons named as defendants are presumed innocent until proven guilty. A pre-trial conference and a trial date will be set and the United States will be required to prove the allegations set forth in the indictment beyond a reasonable doubt.
