Two Bakersfield Men Charged with Being Felons in Possession of a Firearm

FRESNO, CA—United States Attorney Benjamin B. Wagner announced that a federal grand jury returned two separate and unrelated indictments today charging Ricky Lee Allen, 29, and Demond James Hayden, 30, both from Bakersfield, with being felons in possession of a firearm.

The indictment against Allen alleges that on December 28, 2010, Allen knowingly possessed a Hi-Point .380-caliber pistol after two felony convictions: one in 2009 for obstructing a police officer and one in 2001 for conspiracy to possess with intent to distribute cocaine base.

The indictment against Hayden alleges that on December 22, 2010, Hayden knowingly possessed three weapons: a Hi-Point .45-caliber handgun, a Glock Model 22 .40-caliber handgun, and Mossberg 500 shotgun. According to the indictment, Hayden was convicted in 2003 of possessing cocaine for sale and in 2006 of being a felon in possession of a firearm.

These cases are the product of investigations by the FBI and the Bakersfield Police Department as part of the Kern Country Violent Crime Gang Task Force. Assistant United States Attorney Elana Landau is prosecuting the cases.

If convicted, the defendants each face a maximum of 10 years in prison and a $250,000 fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.

The charges are only allegations and the defendants are presumed innocent until and unless proven guilty beyond a reasonable doubt.
