Two Defendants Appear in Federal Court on Indictment Charging Conspiracy to Distribute Heroin Multi-Agency Investigation of Large Heroin Drug Trafficking Ring Results in Federal Indictment

MEDFORD, OR—Ismael Anaya, aka “Chivo,” 27, and Eliot Delavirgen, aka “Alex,” 33, appeared today before U.S. Magistrate Judge Mark Clarke on federal drug charges. A federal indictment alleges that Anaya and Delavirgen were part of a criminal conspiracy to possess and distribute heroin. The penalty for the conspiracy charge carries a mandatory minimum sentence of ten years with a maximum of life and a $4,000,000 fine. The indictment also contains a forfeiture allegation seeking forfeiture of proceeds of the heroin trafficking and property used to facilitate the heroin trafficking. Anaya is scheduled to appear on Wednesday, October 7, and Delavirgen on Tuesday, October 13 for detention hearings.

The indictment was returned by a federal grand jury as part of an ongoing investigation of an alleged heroin drug trafficking organization working out of the Rogue Valley. The numerous local, state and federal law enforcement agencies involved in this investigation include: FBI, Medford Area Drug and Gang Enforcement Team, Medford Police Department, Drug Enforcement Administration, ICE, Jackson County Sheriff’s Department, Southern Oregon TNT, Oregon State Police, RADE Team, Ashland Police Department, Grants Pass Police Department, Josephine County Sheriff’s Department, Talent Police Department, Phoenix Police Department, Central Point Police Department, Klamath Falls Police Department, DHS-Child Welfare, U.S. Attorney’s Office, Jackson County District Attorney’s Office and the Oregon Department of Justice.

The multi-agency investigation resulted in approximately 160 municipal, county, state, and federal law enforcement officers executing 14 search warrants early on the morning of October 4, 2009 at various locations throughout Jackson County.

The case is being prosecuted by Assistant U.S. Attorneys Pamala R. Holsinger and Byron Chatfield.

An indictment is only an accusation of a crime, and a defendant should be presumed innocent unless and until proven guilty.
