Huntington Man Pleads Guilty to Selling Crack Cocaine

HUNTINGTON, WV—Daniel K. Leggette, 34, of Huntington, West Virginia, pled guilty today before United States District Judge Robert C. Chambers to possession with intent to distribute 5 or more grams of cocaine base. Leggette, who is scheduled to be sentenced on April 12, 2010, faces up to 40 years in prison and a $2 million fine.

The conviction stems from a joint investigation conducted by the Huntington Police Department, Huntington Drug and Violent Crime Task Force, Federal Bureau of Investigation, West Virginia State Police, Drug Enforcement Administration and the Bureau of Alcohol, Tobacco, Firearms and Explosives. Leggette was arrested in May 2008, following the execution of a search warrant at a Huntington residence. Upon entering the residence, officers observed Leggette attempt to flee the scene by exiting through a back door. An officer stationed at the back of the residence observed Leggette throw what later was found to be four bags containing individually wrapped crack cocaine. Officers also seized digital scales and a loaded 9mm pistol from Leggette’s vehicle which was parked adjacent to the searched residence. According to court documents, Leggette agreed the firearm belonged to him. Further, as part of his plea agreement, Leggette stipulated that he is a career offender. According to court documents, Leggette was convicted in 1996 in Michigan of possession with intent to deliver cocaine. He was also convicted of unlawful wounding in the Circuit Court of Cabell County, West Virginia in 2007.

Assistant United States Attorney Lisa G. Johnston is handling the prosecution.
