Five Federal Inmates Indicted on Assault and Weapons Charges

CLARKSBURG, WV—Five federal inmates were named in four separate Indictments returned today (November 4, 2009) by a Federal Grand Jury sitting in Clarksburg, West Virginia.
Acting United States Attorney Betsy C. Jividen announced that:

JONATHAN HEILIGH, age 33, an inmate at FCI Cumberland, and DOMINIQUE OUTLAW, age 29, an inmate at USP Hazelton, were named in a three-count Indictment. Count One of the Indictment alleges that HEILIGH and OUTLAW aided and abetted each other in the assault of another inmate with a dangerous weapon with the intent to do bodily harm on April 16, 2009, at USP Hazelton. Counts Two and Three of the Indictment allege that HEILIGH assaulted officers with a dangerous weapon, while the officers were engaged in the performance of their official duties at USP Hazelton. If convicted, the defendants face a maximum penalty of 10 years imprisonment and a fine of $250,000 on Count One of the Indictment; and a maximum penalty of 20 years’ imprisonment and a fine of $250,000 each on Counts Two and Three of the Indictment.

MITHCELL LEON FARKAS, age 40, an inmate at USP Hazelton, was named in a two-count Indictment. Count One of the Indictment alleges that FARKAS assaulted another person with a dangerous weapon on July 31, 2009, at USP Hazelton. Count Two of the Indictment alleges that FARKAS unlawfully possessed a weapon on July 31, 2009. If convicted, FARKAS faces a maximum penalty of 10 years’ imprisonment and a fine of $250,000 on Count One of the Indictment; and a maximum penalty of five years imprisonment and a fine of $250,000 on Count Two of the Indictment.

COREY RICH, age 39, an inmate at FCI Gilmer, was named in a two-count Indictment. Count One of the Indictment alleges that RICH assaulted another person at FCI Gilmer with a dangerous weapon on March 7, 2009. Count Two of the Indictment alleges that RICH unlawfully possessed a weapon on March 7, 2009. If convicted, RICH faces a maximum penalty of 10 years imprisonment and a fine of $250,000 on Count One of the Indictment; and a maximum penalty of five years imprisonment and a fine of $250,000 on Count Two of the Indictment.

RICHARD MADRID, age 27, an inmate at USP Hazelton, was named in a one-count Indictment. The Indictment alleges that MADRID assaulted another inmate with a dangerous weapon on May 26, 2008, at USP Hazelton. If convicted, MADRID faces a maximum penalty of 10 years imprisonment and a fine of $250,000.

It should be noted that the charges contained in the Indictments are merely accusations and not evidence of guilt, and that each defendant is presumed innocent until and unless proven guilty.

The cases will be prosecuted by Assistant United States Attorney David E. Godwin. The cases were investigated by the Federal Bureau of Investigation.
