Levittown Man Charged with Pharmacy Burglary, Possession with Intent to Distribute Controlled Substances

Today Gary J. Robinson, Jr. was charged in a two-count indictment1 with one count of pharmacy burglary and one count of possession with intent to distribute controlled substances, announced United States Attorney Michael L. Levy. The indictment charges that on August 13, 2009, the defendant burglarized the Rite Aid Pharmacy at 2327 Cottman Avenue, Philadelphia, Pennsylvania, with intent to steal materials and compounds containing any quantity of a controlled substance, including but not limited to Amphetamine salts, Methylphenidate (Ritalin), Hydromorphone, Methadone, Morphine Sulfate, Oxymorphone, and, Oxycodone (Oxycontin, Percocet), and 20 Fentanyl Transdermal system patches; all Schedule II controlled substances; and whose replacement value was not less than $500. The indictment further charges that the defendant possessed these controlled substances with intent to distribute them.

If convicted, the defendant faces a maximum sentence of 40 years in prison, a mandatory minimum three years up to lifetime supervised release, a $500,000 fine, and a $200 special assessment. The case was investigated by agents from the Federal Bureau of Investigation, the Philadelphia Police Department, and the Middletown Township Police Department in Bucks County, and is being prosecuted by Assistant United States Attorney Thomas M. Zaleski.
