Hyde Park Man Arrested for Engaging in and Photographing Sexual Activity with a Minor

PREET BHARARA, the United States Attorney for the Southern District of New York, announced that ALLEN DAY, 54, of Hyde Park, New York, was arrested yesterday and charged with sexual exploitation of a minor.
According to the Complaint filed in White Plains federal court:
DAY engaged in sexual activity with a 15-year old girl and photographed the activity with a digital camera. On September 11, 2009, officers of the Hyde Park Police executed a search warrant on DAY's home and recovered, among other things, a computer containing photographs of DAY engaged in sexual activity with the girl.
DAY was presented in White Plains federal court before United States Magistrate Judge LISA MARGARET SMITH yesterday afternoon. He was detained without bail. If convicted, DAY faces a mandatory minimum sentence of 15 years in prison and a maximum term of 30 years in prison.
Mr. BHARARA said that the investigation is ongoing, and requests that any individuals with relevant information contact the Federal Bureau of Investigation in Goshen, New York at (845) 615-1700.
Mr. BHARARA praised the Federal Bureau of Investigation, the Hyde Park Police Department, the Dutchess County District Attorney’s Office, the Rockland County Sheriff's Department, and the New York State Police for their collective work on this case.
Assistant United States Attorney MARCIA S. COHEN is in charge of the prosecution.
The charges contained in the Complaint against the defendant are merely accusations, and the defendant is presumed innocent unless and until proven guilty.
